Seems like the problem did start when Fulcrum took over Amigo... as far as Javier Vega starting a new energy company... "10K Energy" Google-It.

I found it too. The watchdog (Dave Lieber) can really dig. http://www.hcdistrictclerk.com/eDocs/Public/Search.aspx

put “fulcrum” in the defendant field and it comes up. It’s the 7th document that says its 61 pages but skip past the buildup and go straight to where they fire him. Its only 4 pages of reading pages 39-42.

It says that ALL the bigtime fulcrum execs and the people that were supposed to be working for Vega were in the room and they all knew the PUC had ordered them to reduce the billing rate. Vega was left out of it and walked in on them and found them writing a collections letter with the higher rate stated even though the PUC told them the rate was unauthorized. It sounds like the call center people were being kept in the dark because all of page 39 is the script they gave the phone people that said they were going to communicate in writing after they got the rate straight with the PUC. At the bottom of page 40, Vega told them not to mail the letter with an unauthorized rate and said “we could all personally get in a lot of trouble for this.” They don’t stop. Next, at the bottom of page 41 Vega calls the CEO of Fulcrum Power that he DOESN’T WANT TO GET INDICTED!” and he was going home to tell his wife he’s going to quit if the Manalac guy was going to “do what was being contemplated” which I guess is sending the letter. They still don’t stop. As if that wasn’t enough, next, at the top of page 42, Vega actually sends an e-mail to all the big-whigs and his employees and tells them to get the rate cleared by the PUC before they mail it out. Then they fire him.

The letters they sent and all the e-mails are included as exhibits.
